Opposition parties in
Pakistan have filed a no-confidence motion against Prime Minister Imran Khan.
Being considered important
.

Opposition leaders
have repeatedly voiced their concerns over the role of the speaker, and on
Saturday PML-N president Shahbaz Sharif reiterated his concerns
.

Speaking to media,
Shahbaz Sharif slammed Speaker National Assembly Asad Qaiser and warned him to
play his role as Speaker “otherwise his name will be written in very bad
words in history
“.

Addressing the Speaker
National Assembly, he said that he should not be a tool of Imran Khan and
should not allow democracy to derail, otherwise history and people will not
forgive him. Asad Qaiser’s participation in PTI meetings is an insult to office
. ‘ ۔

Some of the questions
that are circulating in everyone’s mind at the moment are how the action on the
confidence motion against the Prime Minister of Pakistan Imran Khan will
proceed and on what day the voting on this motion will take place
.

These are the
questions that are on everyone’s mind at the moment but in such a situation a
video of the Speaker of the National Assembly Asad Qaiser came out on Thursday
in which he can be heard saying that he can adjourn the session of the Assembly
indefinitely. Are

However, a few hours
later, the speaker’s Twitter account denied the allegations. But after the
Speaker’s video came to light, a new debate has arisen over the powers of the
Speaker to adjourn the sitting indefinitely
.

It is to be noted that
the Speaker National Assembly has been criticized by the opposition parties for
his controversial statements before. Pakistan Peoples Party leader Murtaza
Wahab while commenting on the video statement of Asad Qaiser in a press
conference Has been accused of bias
.

According to Murtaza
Wahab, he (Asad Qaiser) is not the Speaker of the National Assembly, he is
Imran’s Tiger. They should play their role and the role is the constitution of
Pakistan
.

When Interior Minister
Sheikh Rashid was asked by a journalist during his press conference on Friday
about the date of the vote on the no-confidence motion, he replied that it is
within the powers of the Speaker and you should ask him this question.
According to Sheikh Rashid, “How far will the no-confidence motion go? After
the reference in the Supreme Court, go to this ‘court’ and go to the Supreme
Court. After confirmation, Information Minister Fawad Chaudhry said that the
government would approach the Supreme Court regarding the legality of the vote
of these members in the no-confidence motion
.

After such criticisms
and interpretations, the question now arises as to how much power the Speaker
has to proceed with the proceedings of such a meeting
.

The BBC has spoken to
experts about the powers of the Speaker and sought to know what powers the
Speaker has and what action can be taken against him if he exceeds his powers.
Is. The role of the speaker is that of the post office
.

Ahmed Bilal Mehboob,
an expert on constitutional and parliamentary affairs in Pakistan, told the BBC
that the constitution on the no-confidence motion was very clear and that the
role of the speaker was that of the post office
.

According to him,
“the highest office is held by the Prime Minister, but he is not exempt
from what is written in the constitution
.”

According to Ahmed
Bilal, there have been no-confidence motions against the Speaker and the
Chairman of the Senate, during which he has quietly confronted such movements
in a constitutional manner
.

According to him,
“If the meeting could be adjourned indefinitely, then no one could ever
bring distrust
.”

Responding to a
question, he said, “Courts give immediate verdicts in such cases so that
no such constitutional process is stalled.” The requisition was also
submitted to the Secretariat along with the requisition to convene a meeting of
the National Assembly under Article 54-3 of the Constitution
.

According to Ahmed
Bilal Mehboob, “earlier no-confidence motions were also filed against
former prime ministers Benazir Bhutto and Shaukat Aziz, who were used by the
then speakers in accordance with the constitution and rules
.”

Under the
constitution, the speaker is required to convene a meeting of the National
Assembly within 14 days after the opposition recused himself. According to the
rules, voting on a no-confidence motion cannot take place before three days and
after seven days after the resolution is tabled in the assembly. According to
former law secretary Karamat Niazi, “the constitution and the rules are
very clear. Now, if anyone offers a different explanation, then it could be his
own personal opinion
.”

It should be noted
that Karamat Niazi has also been the long time secretary of the National
Assembly. According to him, there is not much ambiguity in this regard now as
there are court decisions on it. Can action be taken against the Speaker
?

According to Karamat
Niazi, the courts are open and if any such unconstitutional action is taken,
then such a decision will be taken in court
.

It can be done.

Ahmed Bilal Mehboob also
agrees. According to him, “action can be taken against anyone who goes
against the constitution.”

According to him, if the
Speaker transgresses his authority or violates the Constitution, then Article 6
of the Constitution is very clear. In response to a question, he said that no
speaker has ever violated the constitution in the past. However, the speakers
have been making mistakes.

According to Karamat
Niazi, if Speaker Asad Qaiser adjourns the assembly session indefinitely, then
his decision can be challenged in court.

According to him, the
courts give immediate relief in such cases. According to him, the beauty of
democracy is that it has a system of ‘check and balance’.

“It is not
that everything is exempt, the exemption is only to the extent of what was said
in the meeting that if something is said against someone then it cannot be
challenged in any court.”
